You accept the terms of this agreement if you access the Site or if you register for the Service by sending the appropriate messages from your mobile phone. In either case you further agree to be bound by the Privacy and Security policies set forth in the documents, Privacy Policy and Security Policy included here by reference, including all future amendments to both documents, which will become effective when posted to this website. You also warrant that you are not a minor and are competent to enter into this Agreement. You also represent that if you are accepting the Agreement you are capable of being bound by such an agreement. You should print or otherwise store a copy of this entire agreement for your future reference.

AllTrack is a service primarily offered through the subscribers’ mobile phones. A subscriber registers for the service by sending a text message explicitly initiating the service. The registration is completed by the subscriber sending via SMS an email id to be associated with the phone number from which the message is sent. The service comprises of a sequence of messages exchanged between the subscriber and the system as defined by AllTrack that results in information of relevance and use to the subscriber being captured, catalogued, and managed by the Service. As a key part of the Service, the collated information is periodically emailed to the subscriber to the registered email address in the form of a spreadsheet or similar format. The subscriber can, from the mobile phone, query and retrieve information that has been sent in earlier, either individually, or in some aggregate form. Along with the requested information the subscriber may also be sent information from third party sources, including promotional and commercial information that may be of use and relevance to the subscriber. The subscriber is given the facility to opt out of receiving such additional information.

AllTrack is thus purely a service that collects information sent in by the subscribers and makes such information available back to the subscriber in the form of text messages or email in individual or aggregate form. No sensitive financial or bank information is collected from subscribers nor or there any transactions conducted between the subscriber and any other party.

Your phone number and your email id constitute your Registration Information. We respond to messages from registered phones without further verification of the authenticity of the user on the assumption that your mobile phone will be secured by you. You agree that it is your responsibility to keep your mobile phone secure and to ensure that others do not have access to it. You also agree that securing your email id and its password is your responsibility. You further agree to intimate any breach of the above security by sending us an email at security@alltrack.in.

You agree that your Registration Information is for only your personal use and does not permit you to transfer the usage rights to any third party. By providing your phone number you agree that as long as you are bound by this agreement any messages that you receive from us on the phone will not be considered as unsolicited messages. Further by providing your email ID you agree to receive all required notices electronically.

Your use of the service may be interrupted from time to time due to various causes, including, without limitation, equipment failure, network failure, software bugs, maintenance and upgrading of the software or hardware at the Site etc., taken up at the sole discretion of the Company.

Usage of the Service is by the payment of a subscription fee as described in the Site. The payment is collected online using the services of a third party payment gateway provider (ebs.in). The security of your payment information is subject to the Terms of Use and Security and privacy policies of our gateway provider. It is your responsibility to ensure that these terms are acceptable to you before making the payment.

You can choose to subscribe to one of a few possible durations of service (one month, one year etc., as detailed in the Site). You can choose to not renew your subscription at any time. However there will be no refund of paid up subscriptions for any reason.

The Company reserves the right to change the subscription fees, offer discounts and free trial subscriptions and other promotions at its discretion at anytime without prior notice.

We will provide sufficient notice via email and text messages about the expiry of your subscription. However it is your responsibility to renew the subscription before the due date. Once the subscription expires, the service will no longer be available to you. We do not guarantee the availability of your previously accumulated data if there is a break in your subscription.

By providing your Registration Information you grant us the right to send you text messages on your mobile phone in response to your queries as well as for us to unilaterally send you information for the purposes of enhancing the quality of the Service. You grant us the license to use and share the data that you send to us as part of your use of the Service, in the aggregate, with no personally identifiable information, for the sole purposes of improving the service and your experience, subject to the provisions set forth in our Privacy and Security Policies which are included here by reference. You explicitly give up claims to any intellectual property rights on the data that you have sent to us as part of your use of this Service. You will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to any claims resulting from your illegal or improper use of this Service.

The name AllTrack, the contents of the website alltrack.in, including the look-and-feel and the software programs used, are the sole property of the Company and are governed by various Intellectual property laws of India. These contents are licensed to you for your own personal, internal and non-commercial use only and subject to the conditions listed in this Agreement. This usage is non transferrable. We expressly prohibit the redistribution, sale or any other use of this content without the written consent of the Company which may be declined at the sole discretion of the Company.

Use the Service for any illegal and unlawful activities.

Violate or attempt to violate the privacy of other users or to cause harm or damage to anyone.

Cause any disruption of the Service by wilfully introducing viruses, worms or by any other means.

Attempt to reverse engineer any of the software that is being used for the delivery of the Service.

Disrupt the ability of other users to use the Service.

AllTrack depends on the services of telecom providers to send out and receive text (SMS) messages and hence cannot guarantee the reliable delivery of messages in either direction. AllTrack does not also guarantee timely delivery of messages since the messages can be delayed for indefinite periods of time or lost in transit due to congestion and other causes in the network. AllTrack makes the best effort possible to communicate with the subscribers about disruptions in the service and also to rectify the disruption at the earliest.

AllTrack does not claim to provide certified accounting services or any other formal service or transactional oversight. The content sent to us by the subscribers is collected, aggregated and presented back to the subscriber without any modifications. All messages sent to AllTrack may not reach it due to various reasons including the failure of the telecom operator to deliver the messages and as such AllTrack does not guarantee 100% receipt of all messages nor guarantee the delivery of every message or alert sent to subscribers.

AllTrack may modify this agreement from time to time at its discretion and the modified agreement becomes effective from the date of posting on this site. This document will always display the last date of modification. You are deemed to have agreed to the modified Agreement if you use the service after the last date of modification.

The Agreement will terminate if your subscription expires or if we unilaterally terminate the Agreement for your breach of any of the provisions of the agreement. In case of termination due to breach of the Agreement by you there will be no refund of the subscription fee and we reserve the right to claim damages from you for the breach. Upon termination all access to the Service will cease and your obligations under this Agreement that naturally survive the termination, including, without limitation, intellectual property rights, limitations of liability, and indemnity will continue to be in force.

• To the extent that any provision or provisions of this Agreement are unenforceable they shall be deemed to be deleted from this Agreement, and any such deletion shall not affect the enforceability of the remainder of this Agreement not so deleted provided the fundamental terms of the Agreement are not altered.
• This Agreement constitutes the whole agreement between you and AllTrack relating to the subject matter hereof.
• The Agreement shall be governed by the Laws of India. The Courts of law at Bangalore shall have exclusive jurisdiction over any disputes arising under this agreement.
